Where Kratom Is Banned

These states ban selling or possessing kratom. Some bans are new in 2026, so older maps are often wrong.

  • Long-standing bans: Alabama, Arkansas, Indiana, Vermont and Wisconsin.
  • Louisiana: banned from 1 Aug 2025.
  • Connecticut: banned by regulation from 25 Mar 2026.
  • Kansas and Tennessee: banned from 1 Jul 2026.
  • North Dakota: banned since 5 Aug 2026. A regulated market waits on state rules, expected 2027 at the earliest.
  • Massachusetts: emergency Schedule I listing from 28 Aug 2026, for up to one year.
  • California: the health department treats kratom foods and supplements as illegal to sell, including online.
  • Kentucky: legal at 21+ until a ban starts on 1 Jan 2027. A court challenge is pending.

Rhode Island ended its ban on 1 Apr 2026. However, only licensed shops may sell, so delivery stays illegal.

States That Ban or Cap 7-OH

7-OH rules are stricter than kratom rules. Besides the full bans above, these places ban 7-OH products:

District of Columbia, Florida, Kentucky, Ohio, Virginia.

Meanwhile, these states cap 7-OH or allow only natural-leaf products:

Arizona, Colorado, Georgia, Maryland, Mississippi, Nebraska, Oklahoma, Rhode Island, Texas, Utah, West Virginia, Wyoming.

Most 7-OH tablets exceed a 1% or 2% cap. So we treat a cap as a block for 7-OH products.

Federal Status

Kratom leaf and mitragynine are not federally controlled. However, two federal actions matter right now.

  • Schedule I since 26 Aug 2026: mitragynine pseudoindoxyl, MGM-15 and MGM-16, with no threshold.
  • Pending for 7-OH: the DEA proposed Schedule I above 0.05%, or 1 mg per unit. No order exists yet.

Why Kratom Legality by State Keeps Changing

States move in two directions at once. Some pass consumer protection acts, while others ban kratom outright.

2026 brought bans in Connecticut, Kansas, Tennessee, North Dakota and Massachusetts. Rhode Island, by contrast, ended its ban.

Local rules add another layer. For example, Mississippi has more than 30 county and city bans.

Common Questions

Is kratom legal federally?

Yes. Kratom leaf and mitragynine aren’t federally scheduled. However, 7-OH is under review, and three related compounds are Schedule I.

Which states ban kratom in 2026?

Alabama, Arkansas, California, Connecticut, Indiana, Kansas, Louisiana, Massachusetts, North Dakota, Tennessee, Vermont and Wisconsin. Kentucky follows on 1 Jan 2027.

Is kratom legal in Rhode Island now?

Yes, at licensed shops for adults 21+. Delivery to customers isn’t allowed, so online stores can’t ship there.

What does a 7-OH cap mean?

It limits 7-OH to a share of total alkaloids, often 1% or 2%. Most 7-OH tablets go far above that.
